Biko Today is an AI and ML-driven workforce platform that connects students and young professionals with SMEs and organisations needing affordable business support.

Our services may include:

• Workforce-as-a-Service
• Student and young professional training
• SME business support
• Marketing and content support
• Administration and research support
• Website, automation and digital operations support
• Data management and business process support
• AI and ML-assisted productivity tools
• Client project delivery
• Subscription-based and once-off digital services
• Platform tools and systems made available to users

Specific services may be subject to separate proposals, statements of work, service agreements, student agreements, internship agreements, subscription terms or project-specific terms.

4. Eligibility

By using our services, you confirm that:

• You are at least 18 years old; or
• You have the consent of a parent, guardian, institution or lawful representative where required; and
• You have the legal authority to accept these Terms on your own behalf or on behalf of the organisation you represent.

If you use Biko Today on behalf of a company, SME, institution or organisation, you confirm that you are authorised to bind that organisation to these Terms.

5. Accounts and Access

To access certain services, you may need to create an account.

You agree to:

• Provide accurate and complete information
• Keep your login details secure
• Not share your account with unauthorised persons
• Notify us immediately of any unauthorised access
• Keep your account information updated
• Use the platform only for lawful and authorised purposes

We may suspend or terminate access if we reasonably believe that an account has been misused, compromised, used unlawfully, or used in breach of these Terms.

6. Student and Young Professional Users

Students, interns and young professionals using Biko Today agree that:

• Participation does not automatically create employment with Biko Today or any client
• Work opportunities may depend on performance, availability, skills, client needs and programme requirements
• Training, mentorship and project work may form part of the platform experience
• Any stipends, support payments or resource support are not guaranteed unless approved in writing
• Any work produced through Biko Today must meet required quality, conduct and confidentiality standards
• Biko Today may assess delivery, performance, skills development, reliability and professionalism
• Client information, business data and project materials must be treated as confidential

Biko Today may remove a student or young professional from a project, programme or platform where conduct, delivery, reliability, confidentiality or performance does not meet required standards.

7. SME, Client and Business Users

SMEs, clients and business users agree to:

• Provide accurate business information
• Give clear briefs, feedback and required materials
• Pay agreed fees on time
• Use deliverables only as permitted under the relevant agreement
• Treat students, young professionals and Biko Today team members professionally
• Not bypass Biko Today to privately recruit, contract or solicit platform talent unless agreed in writing
• Not upload unlawful, harmful, misleading, infringing or confidential third-party material without authority

Biko Today may refuse, pause or terminate services where a client acts unlawfully, fails to pay, abuses staff or students, provides misleading information, or uses the platform in bad faith.

8. Services, Pricing and Availability

Service descriptions, pricing, packages and availability may change from time to time.

Where services are sold online, the displayed price, service description and checkout process will apply unless otherwise agreed in writing.

Biko Today may offer:

• Once-off services
• Subscription services
• Demo-based services
• Managed services
• Custom project work
• Enterprise, institutional or government services
• AI-powered or platform-based services

We reserve the right to accept, reject, suspend, amend or discontinue any service, package or platform feature at any time.

9. Payments

Payments may be processed through third-party payment providers, including Yoco, PayFast, Stripe, Paystack or other approved providers.

By making payment, you agree to the applicable payment provider’s own terms and privacy policies.

Unless otherwise stated in writing:

• Fees must be paid in advance
• Subscription fees renew according to the selected billing cycle
• Late payment may result in suspension of services
• Bank charges, payment gateway fees or foreign exchange charges may apply
• Prices may exclude applicable taxes unless stated otherwise

Biko Today does not intentionally store full card details unless lawfully handled through secure payment infrastructure.

10. Refunds, Cancellations and Service Credits

Refunds and cancellations depend on the type of service purchased.

Unless otherwise agreed in writing:

• Digital products, setup work, strategy work, consulting, completed services and custom work are non-refundable once work has started
• Subscription cancellations apply from the next billing cycle unless otherwise stated
• Domain registration, hosting, third-party tools, paid media spend, software licences and external provider fees are generally non-refundable once processed
• If Biko Today cannot deliver a paid service due to our own fault, we may offer a refund, service credit, replacement service or revised delivery timeline
• No refund will apply where the client fails to provide required information, access, approvals, content or feedback needed to complete the work

Nothing in this section limits any mandatory consumer rights that may apply under law.

11. AI and ML Tools

Biko Today may use AI, ML and automation tools to support productivity, training, research, content creation, workflow management, quality control, business analysis and project delivery.

You understand and agree that:

• AI-generated outputs may contain errors or omissions
• AI outputs should be reviewed before use
• AI tools do not replace professional, legal, financial, medical or tax advice
• Biko Today may use third-party AI service providers
• Users must not submit unlawful, confidential or third-party protected information unless authorised
• Users remain responsible for how they use outputs created through the platform

Biko Today does not guarantee that AI outputs will be error-free, complete, original, suitable for every purpose, or accepted by any third party.

12. User Content

“User Content” means any information, documents, files, briefs, images, data, messages, instructions, feedback or materials submitted by users.

You retain ownership of your User Content, but you grant Biko Today a limited licence to use, process, store, copy, modify, display, transmit and share it as necessary to:

• Provide services
• Operate the platform
• Deliver client work
• Manage accounts and projects
• Improve platform performance
• Comply with legal and contractual obligations
• Protect our rights, users, systems and services

You confirm that you have the right to submit all User Content you provide.

You must not upload content that is unlawful, harmful, defamatory, discriminatory, abusive, misleading, infringing, confidential without authority, or harmful to Biko Today, users or third parties.

13. Intellectual Property

All Biko Today technology, branding, website content, platform design, workflows, software, dashboards, systems, documentation, methods, training material, business models, AI workflows, designs, trademarks and related intellectual property belong to Biko Today or its licensors.

You may not copy, reproduce, sell, reverse engineer, scrape, modify, distribute, imitate or exploit Biko Today intellectual property without written permission.

Where Biko Today creates deliverables for a client, ownership and usage rights will be determined by the applicable proposal, invoice, service agreement or statement of work.

Unless otherwise agreed in writing:

• Biko Today retains ownership of its tools, templates, systems, processes, methods and pre-existing intellectual property
• Clients receive a usage licence for completed and paid-for deliverables
• Drafts, rejected concepts, internal working files and platform processes remain Biko Today property
• Unpaid work remains Biko Today property until full payment is received

14. Confidentiality

Users may receive access to confidential business, student, client, operational, financial, technical or personal information.

You agree not to disclose, misuse, copy, sell or distribute confidential information without written permission.

This duty continues after your use of the platform or services ends.

15. Acceptable Use

You may not use our website, platform or services to:

• Break any law
• Commit fraud or misrepresentation
• Harass, abuse, exploit or harm others
• Upload viruses, malware or harmful code
• Attempt to hack, overload, scrape or disrupt our systems
• Reverse engineer or copy our platform
• Infringe intellectual property rights
• Upload unlawful or unauthorised personal data
• Send spam or unauthorised marketing
• Misrepresent your identity or affiliation
• Circumvent payment, access controls or usage restrictions
• Recruit, solicit or bypass Biko Today’s talent, clients or partners without written approval

We may suspend or terminate access for any breach of this section.

16. Third-Party Services

Biko Today may integrate with or link to third-party tools, websites, platforms, payment providers, hosting providers, AI providers, analytics tools, communication tools and software services.

We are not responsible for third-party platforms, terms, policies, security, uptime, pricing, errors or service failures.

Your use of third-party services may be governed by their own terms and privacy policies.

17. Privacy and Data Protection

Your use of our website and services is also governed by our Privacy Policy and Cookie Policy where applicable.

By using our services, you agree that Biko Today may collect and process personal information as described in our Privacy Policy.

18. Service Availability

• All outputs will be error-free
• AI-generated work will be fully accurate
• Business results, sales, funding, jobs or employment outcomes are guaranteed
• Students will be placed into permanent jobs
• SMEs will achieve specific revenue or growth outcomes
• Third-party services will function without interruption

Biko Today provides practical business support, training, technology and workforce services, but results depend on many factors outside our control.

20. Limitation of Liability

To the maximum extent permitted by law, Biko Today will not be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, data, goodwill, business opportunities, customers, reputation or expected savings.

Where liability cannot be excluded by law, Biko Today’s total liability will be limited to the amount paid by the user for the relevant service giving rise to the claim, or where no payment was made, to the maximum amount permitted by law.

Nothing in these Terms excludes liability where the law does not allow exclusion.

21. Indemnity

You agree to indemnify and hold Biko Today, its directors, employees, contractors, partners and representatives harmless from any claims, damages, losses, liabilities, costs or expenses arising from:

• Your User Content
• Your infringement of third-party rights
• Your failure to obtain required permissions, consents or licences

• You fail to pay fees due
• You misuse the platform
